These Terms of Service govern your access to and use of the Sweet Cherry Adventures website, online booking system, guest portal, trip-planning tools, communications, and related digital services. By using the website or affirmatively accepting these Terms during a reservation request, you agree to these Terms. Our Privacy Policy explains how personal information is collected and used.
Rental Agreement controls the actual rental
These Terms govern website and booking-system use. An actual camper rental is separately governed by the Rental Agreement electronically signed for that reservation and by the confirmed reservation details. If these Terms conflict with a signed Rental Agreement concerning an actual rental, the signed Rental Agreement controls that rental-specific issue.
Eligibility
You must be legally capable of entering a contract to make a reservation request. The primary renter must satisfy the eligibility requirements displayed during checkout and in the Rental Agreement, including Sweet Cherry Adventures' minimum renter age and any identity-verification requirements. We may refuse or cancel a reservation request when required information is incomplete, inaccurate, fraudulent, unverifiable, or inconsistent with our rental requirements.
Website information
We make reasonable efforts to keep camper descriptions, photographs, pricing, availability, campground information, mileage, delivery information, and other content accurate. Information may nevertheless change or occasionally contain errors. Third-party campground, map, weather, distance, travel, or other information is provided for convenience and should be independently confirmed when important to your trip.
Quotes and pricing
Quotes are calculated using information available when the quote is requested, which may include rental dates, camper selected, seasonal pricing, destination, delivery distance, guest selections, applicable fees, taxes, and optional services. A quote does not reserve dates. Pricing may change until a reservation hold is successfully created. The pricing snapshot associated with an approved and confirmed reservation will control unless the parties later agree to a modification.
Reservation holds and requests
Availability displayed on the website does not guarantee that a camper will remain available. A temporary reservation hold may be created while checkout is completed. The hold expires automatically if the required checkout steps are not completed before the displayed deadline. Submitting a reservation request does not guarantee acceptance.
The Sweet Cherry Adventures booking process may require the guest to review reservation information and these Terms; electronically sign the Rental Agreement; provide an acceptable payment method; complete identity verification; and await final approval by Sweet Cherry Adventures.
Payment authorization, saved payment method, and approval
After the Rental Agreement has been signed, our payment processor may authorize the Renter's payment method for the amount displayed at checkout. An authorization is not a completed charge. Sweet Cherry Adventures reviews the reservation after required guest steps are complete.
As disclosed during checkout and in the Rental Agreement, the payment processor may save the reservation payment method for later use in connection with the same rental. The saved payment method may be used by Sweet Cherry Adventures for valid merchant-initiated, off-session rental-related charges permitted by the signed Rental Agreement, including actual and reasonable documented amounts that exceed the remaining security deposit. Any later charge remains subject to applicable law, card-network rules, payment-provider rules, and issuer approval.
If the reservation is approved, the authorized amount is captured and the reservation is confirmed. If the reservation is declined, expires, or otherwise does not become confirmed, the authorization is released. The timing with which a bank removes a pending authorization is controlled by the bank or card issuer.
Identity verification
A reservation may require identity verification through a third-party verification provider. The Renter must provide truthful information and complete the required process. Sweet Cherry Adventures may decline a request that does not successfully satisfy applicable verification requirements. The handling of identity information is also governed by our Privacy Policy and the applicable third party's terms and privacy practices.
Payments and amounts owed
By submitting a payment method, you represent that you are authorized to use it and authorize charges permitted by the reservation, Rental Agreement, these Terms, and applicable law. You remain responsible for valid amounts owed even if a payment is declined or reversed. A payment dispute or chargeback does not by itself eliminate obligations validly incurred under the Rental Agreement.
For documented post-rental amounts, Sweet Cherry Adventures will apply the available security deposit first. If valid documented charges exceed the remaining deposit, the balance may be processed separately against the saved reservation payment method as authorized in the signed Rental Agreement. If that separate charge cannot be completed, Sweet Cherry Adventures may send a payment request or invoice for the valid balance.
Cancellations and refunds
Cancellation and refund rights for a particular rental are governed by the policy incorporated into the confirmed reservation and Rental Agreement. Before confirmation, a guest may withdraw a reservation request, subject to release of any payment authorization. Refund processing times after Sweet Cherry Adventures initiates a refund may depend on the payment processor, bank, or card issuer.
Guest information
You agree to provide accurate and current information when using the booking system. You may not impersonate another person, use another person's payment method without authorization, intentionally provide an incorrect destination, manipulate pricing or availability, or submit fraudulent or speculative reservation requests.
Acceptable website use
You may use the website only for legitimate personal or business interaction with Sweet Cherry Adventures. You may not attempt unauthorized access to our systems; circumvent security or identity controls; interfere with website operation; scrape the website at a volume that unreasonably burdens the service; introduce malicious code; manipulate prices or reservation availability; or copy website content for unauthorized commercial use. We may restrict access to protect our customers, systems, business, or legal rights.
Third-party services
Sweet Cherry Adventures uses third-party providers for functions that may include payment processing, identity verification, hosting, email, maps, location services, file storage, analytics, and other technology. Those providers may have separate terms and privacy policies. Temporary interruption or failure of a third-party service may delay a transaction or website function. We will make reasonable efforts to restore or provide an alternative process when practicable.
Intellectual property
The Sweet Cherry Adventures name, logos, website design, original written content, photographs, graphics, booking materials, and other proprietary content belong to Sweet Cherry Adventures or their respective licensors. You may view and use website content for ordinary personal use related to planning or managing a reservation. You may not reproduce, sell, republish, or commercially exploit proprietary content without permission except as permitted by law.
Feedback and submissions
If you voluntarily send Sweet Cherry Adventures feedback, suggestions, reviews, photographs, or similar material, you represent that you have the right to provide it. We may use ordinary business feedback and suggestions to improve our services. Public use of a customer's name, likeness, testimonial, or privately supplied trip photograph will be subject to any additional permission required by law or our stated privacy practices.
Website availability and disclaimers
The website and digital services are provided on an available basis. We do not guarantee that the website will always be uninterrupted or error-free. Sweet Cherry Adventures is not responsible for inaccuracies or failures originating from third-party campground listings, mapping services, weather providers, banks, telecommunications providers, or other independent services, except to the extent applicable law provides otherwise. Nothing on the website constitutes legal, medical, weather-safety, campground, or other professional advice.
Limitation of liability
To the extent permitted by law, Sweet Cherry Adventures will not be liable for indirect, incidental, special, or consequential loss resulting solely from use or temporary unavailability of the website or a third-party digital service. Nothing in these Terms limits liability or consumer rights that cannot lawfully be limited. Rental-related liability is governed principally by the signed Rental Agreement.
Electronic transactions and record copies
You agree that reservation transactions may be conducted electronically. Electronic acceptance, notices, confirmations, records, and signatures may be used in connection with a reservation. You should retain copies of important reservation documents. After the Rental Agreement is electronically signed, Sweet Cherry Adventures will make the signed record reasonably available for retention and, when email delivery is available, send the exact signed agreement text to the reservation email address with a link for retrieving another verified copy.
Communications
Transactional communications concerning a reservation may be sent to the email address or other contact information you provide. Marketing email or promotional text messages will be sent only in accordance with the applicable consent provided and applicable law. You may withdraw optional marketing consent without affecting necessary reservation communications.
Governing law and disputes
These Terms are governed by Michigan law, except where another law must apply. Before beginning litigation concerning these Terms, the parties should make a reasonable attempt to resolve the dispute directly. Rental disputes are also subject to the dispute provisions of the applicable Rental Agreement.
Changes to these terms
Sweet Cherry Adventures may update these Terms for future website use or future reservation requests. The version and effective date presented and recorded during checkout identify the Terms accepted for that transaction. A later change to these Terms will not retroactively alter a previously signed Rental Agreement unless required by law or separately agreed by the parties.
